These Terms of Use (“Terms”) govern your access to and use of the VisualNest AI mobile application, website, and related services (collectively, the “Service”). “VisualNest,” “we,” “us,” and “our” refer to the provider of the Service.
By downloading, installing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Acceptance and scope
These Terms form an agreement between you and VisualNest. They apply to visitors, guest users, registered users, and anyone who uploads material to or generates content through the Service. Additional terms presented for a specific feature or platform may also apply; if they conflict with these Terms, the more specific terms govern that feature.
2. Eligibility and accounts
Age requirements
You must be legally able to agree to these Terms. The Service is not directed to children under 13. If the law where you live requires a higher minimum age, that higher age applies. A parent or legal guardian must authorize use by a minor where required.
Guest sessions and account information
Some features may work through a guest session or a persistent service identifier. Other features may ask you to provide or bind an email address. You agree to provide accurate information, keep access credentials secure, and promptly tell us if you suspect unauthorized use.
To request deletion of account-related information, contact us using the address in Section 17. We may ask you to verify your identity. Some records may be retained when reasonably necessary for security, fraud prevention, dispute resolution, or legal compliance.
3. What VisualNest provides
VisualNest offers AI-assisted tools that may include text-to-image, image-to-image, text-to-video, image-to-video, background removal, face replacement, templates, prompt discovery, creation history, previews, retries, and saving generated media. Features, formats, availability, queue times, and output limits may change.
AI generation is probabilistic. A result may not precisely follow your prompt, may contain errors or artifacts, may resemble other content, or may be unsuitable for your intended use. You are responsible for reviewing every output before publishing, relying on, or using it commercially.
4. Your prompts and uploaded content
You retain any rights you already hold in your prompts, photos, images, videos, and other materials you submit (“User Content”). You must only submit User Content you have the right to use.
When User Content identifies another person—especially when using face replacement—you must obtain all permissions required for the intended processing and use. Do not upload private, intimate, or sensitive material without valid authorization.
You grant us a limited, non-exclusive, worldwide license to host, copy, transmit, format, process, and display User Content only as reasonably necessary to operate the Service, complete your generation request, keep requested history, protect the Service, and meet legal obligations. This license ends when the content is deleted from active systems, subject to reasonable technical, backup, security, and legal retention.
5. Generated outputs
Subject to applicable law, these Terms, and any third-party model or asset restrictions disclosed for a feature, you may use outputs generated for you. We do not promise that an output is unique, non-infringing, eligible for intellectual-property protection, accurate, or suitable for commercial use.
You are responsible for your use and distribution of outputs, including obtaining necessary clearances and complying with publicity, privacy, copyright, trademark, consumer protection, advertising, and other applicable laws. You may not represent AI-generated content as authentic evidence or use it to deceive others.
6. Safety and acceptable use
You may not use the Service to create, upload, request, or distribute content that:
- violates any law or another person’s intellectual-property, privacy, publicity, or contractual rights;
- sexually exploits or endangers minors, or depicts minors in sexual contexts;
- uses a person’s face, voice, identity, or private material without required consent, including deceptive impersonation or non-consensual intimate imagery;
- promotes fraud, harassment, hateful conduct, graphic violence, self-harm, malware, or unauthorized surveillance;
- misleads people about elections, public safety, medical matters, or the authenticity of a person or event in a harmful way;
- attempts to bypass safety controls, overload the Service, scrape it, reverse engineer it, or gain unauthorized access; or
- otherwise creates a material risk of harm to users, VisualNest, or third parties.
We may block a request, remove access to content, preserve relevant information, or suspend or terminate access when reasonably necessary to enforce these Terms, respond to a valid report, comply with law, or protect people and the Service.
7. Third-party services
The Service may depend on hosting, storage, content delivery, AI generation, platform, or other third-party services. Their terms and privacy practices may apply to your use of their components. We are not responsible for third-party products or services we do not control.
8. Purchases and subscriptions
If we offer paid features, the price, billing period, included benefits, renewal terms, and cancellation options will be shown before purchase. Purchases made through Apple, Google Play, or another platform are also subject to that platform’s billing, cancellation, and refund rules. An automatically renewing subscription continues until canceled through the applicable platform settings. This section does not mean that a paid feature is currently available.
9. VisualNest intellectual property
The Service, software, interface, brand, logo, templates, documentation, and materials provided by VisualNest or its licensors are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose under these Terms. No other rights are granted.
10. Privacy
Our Privacy Policy explains how we handle information in connection with the Service. You agree that we may process information as described there and in any feature-specific notice presented to you.
11. Service availability and changes
We may add, change, suspend, or discontinue features, limits, or the Service. Generation may be delayed or fail because of queue volume, network conditions, model behavior, maintenance, or third-party availability. We do not guarantee uninterrupted access or permanent storage of User Content or outputs. Keep independent copies of anything important.
12. Disclaimers
To the fullest extent permitted by applicable law, the Service and outputs are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
13. Limitation of liability
To the fullest extent permitted by applicable law, VisualNest and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from the Service. Any limitation applies only to the extent lawful in your jurisdiction and does not limit liability that cannot legally be limited.
14. Your responsibility
To the extent permitted by law, you are responsible for claims, losses, and costs resulting from your unlawful User Content, your misuse of the Service, or your material breach of these Terms. This does not apply where the claim results from VisualNest’s own unlawful conduct.
15. Suspension and termination
You may stop using the Service at any time. We may restrict, suspend, or terminate access if you materially violate these Terms, create risk or legal exposure, or if continued operation is no longer reasonably practical. Sections that by their nature should survive termination—including ownership, disclaimers, and liability provisions—will survive.
16. Changes, law, and disputes
We may update these Terms as the Service or legal requirements change. We will provide notice of material changes where required. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
Applicable law governs these Terms without overriding mandatory consumer protections available where you live. Before filing a formal claim, you and VisualNest agree to try in good faith to resolve the issue by contacting the other party, unless law permits you to proceed directly.
